Your Excellency, I have the honor to present to Your Excellency, at the instruction of my Government, the following requests for the consideration of the Department of State with regard to the recent revised draft of the Japanese Peace Treaty. 

송구하옵니다만, 최근 개정된 일본과의 평화조약의 초안에 관해서 아래와 같이 우리 정부의 지시에 따라 귀 부서의 배려를 부탁드립니다.

1. My Government requests that the word “renounces” in Paragraph a, Article Number 2, should be replaced by “confirm‎s that it renounced on August 9,1945, all right, title and claim to Korea and the islands which were part of Korea prior to its annexation by Japan, including the island Quelpart, Port Hamilton, Dagelet, Dokdo and Parangdo.” 

1. 우리 정부는 제 2 조(a)항의 "포기한다"라는 단어를 '한국, 및 제주도, 거문도, 울릉도, 독도 및 파랑도 등 일본에 의한 한국 병합 이전에 한국의 일부였던 여러 섬들에 대한 모든 권리, 주권 및 청구권을, 1945년 8월 9일에 포기한 것을 확인한다'라고 작성할 것을 요구합니다.

2. As to Paragraph a, Article Number 4, in the proposed Japanese Peace Treaty, my Government wishes to point out that the provision in Paragraph a, Article 4, does not affect the legal transfer of vested properties in Korea to the Republic of Korea and the United States Military Government in Korea, of September 11, 1948. 

2. 제 4 조(a)항에 관해서,우리 정부는 제 4 조(a)항이 1948년 9월 11일 한국과 한국의 미 군정청에 주한 기득 재산의 이관에 영향을 주지 않는 것을 요구합니다.

3. With reference to Article 9, my Government wishes to insert the following at the end of Article 9 of the proposed Peace Treaty, “Pending the conclusion of such agreements existing realities such as the MacArthur Line will remain effect.” 

3. 제 9 조에 관해서,우리 정부는 제 9 조의 말미에 "그런 협정을 체결하기 전에는 맥아더 라인과 같은 기존 사실은 그대로 효력이 남는다"라는 문구의 삽입을 요청합니다.

I have the honor to acknowledge the receipt of your notes of July 19 and August 2, 1951 presenting certain requests for the consideration of the Government of the United States with regard to the draft treaty of peace with Japan.

귀하가 보내신 일본과의 평화 조약의 초안에 관하여 아메리카 합중국 정부의 재고(再考)를 요청하는 1951년 7월 19일 및 8월 2일자의 문서를 확실히 수령했음을 삼가 알려드립니다.

With respect to request of the Korean Government that Article 2(a) of the draft be revised to provide that Japan "confirm‎s that it renounced on August 9, 1945, all right, title and claim to Korea and the islands which were part of Korea prior to its annexation by Japan, including the islands Quelpart, Port Hamilton, Dagelet, Dokdo and Parangdo," the United States Government regrets that it is unable to concur in this proposed amendment.

초안 제2조 (a)항을, 일본은 "한국, 및 제주도, 거문도, 울릉도, 독도 및 파랑도 등 일본에 의한 한국 병합 이전에 한국의 일부였던 여러 섬들에 대한 모든 권리, 주권 및 청구권을, 1945년 8월 9일에 포기한 것을 확인한다"고 규정하도록 수정해야 한다는 대한민국 정부의 요구에 대해서, 유감스럽지만 합중국 정부는 그 제안에 동의할 수 없습니다.

The United States Government does not feel that the Treaty should adopt the theory that Japan's acceptance of the Potsdam Declaration on August 9, 1945 constituted a formal or final renunciation of sovereignty by Japan over the areas dealt with in the Declaration.

합중국 정부는, 1945년 8월 9일의 일본에 의한 포츠담 선언 수락에 의해 동선언의 대상이 되는 지역에 대하여 일본이 공식적, 또는 최종적으로 주권을 포기했다고 하는 이론을 평화 조약에서 채택해야 한다고 생각하지 않습니다.

As regards the island of Dokdo, otherwise known as Takeshima or Liancourt Rocks, this normally uninhabited rock formation wasaccording to our information never treated as part of Korea and, since about 1905, has been under the jurisdiction of the Oki Islands Branch Office of Shimane Prefecture of Japan. The island does not appear ever before to have been claimed by Korea.

독도, 다케시마, 혹은 리앙쿠르 암(巖)으로서 알려져 있는 섬에 대하여, 우리 측의 정보에 의하면, 평상시 사람이 거주하지 않는 이 암초는, 한국의 일부로서 취급되었던 적은 전혀 없으며, 1905년경부터, 일본의 시마네 현 오키 도청(島廳)의 관할하에 있었습니다. 이 섬에 대하여, 한국에서 지금까지 주권을 주장한 적이 있다고 보이지 않습니다.

It is understood that the Korean Government's request that "Parangdo" be included among the islands named in the treaty as having been renounced by Japan has been withdrawn.

"이어도(파랑도)"가 본 조약으로 일본에 의해 포기되는 섬에 포함되어야 하는 것이라고 하는 한국 정부의 요구는 취하되었다고 이해합니다.

The United States Government agrees that the terms of paragraph (a) of Article 4 of the draft treaty are subject to misunderstanding and accordingly proposes, in order to meet the view of the Korean Government, to insert at the beginning of paragraph (a) the phrase, "Subject to the provisions of paragraph (b) of this Article", and then to add a new paragraph (b) reading as follows:

합중국 정부는 초안 4조 (a)항의 문언이 오해를 불러오기 쉽다는 것에 동의하며, 이를 한국 정부의 견해와 일치시키기 위하여, (a)항의 모두(冒頭)에 "본조 (b)항의 규정에 따르는 일을 조건으로써"라는 구절을 삽입하여, 그 다음에 아래와 같이 새로이 (b)항을 추가하는 것을 제안합니다.

(b) "Japan recongnizes the validity of dispositions of property of Japan and Japanese nationals made by or pursuant to directives of United States Military Government in any of the areas referred to in Articles 2 and 3".

(b) 일본은, 제2조 및 제3조에 의해 규정되는 지역에 있으며, 합중국 군정부의 지령에 의해서 이루어진 일본 및 일본 국민의 재산에 대한 처분이 유효함을 인정한다.

The present paragraph (b) of Article 4 becomes paragraph(c).

현재의 4조 (b)항은 (c)항이 됩니다.

The Government of the United States regrets that it is unable to accept the Korean Government's amendment to Article 9 of the draft treaty. In view of the many national interests involved, any attempt to include in the treaty provisions governing fishing in high seas areas would indefinitely delay the treaty's conclusion. It is desired to point out, however, that the so-called MacArthur line will stand until the treaty comes into force, and that Korea, which obtains the benefits of Article 9, will have the opportunity of negotiating a fishing agreement with Japan prior to that date.

합중국 정부는, 한국 정부의 초안 9조 수정안을 받아들이지 못하는 것을 유감스럽게 생각합니다.많은 나라의 이해가 결부되어 있기 때문에, 공해상의 어업을 통제하는 조항을 조약에 포함시키려 하는 것은 조약 체결을 무기한적으로 늦출 수 있습니다. 그러나, 이른바 맥아더 라인은 조약이 발효할 때까지 유효하고, 한국은 9조에 규정된 이익을 얻으며, 해당 발효일까지 일본과 어업 협정을 개시할 수 있는 기회를 얻을 수 있다는 점을 지적하고 싶습니다.

With respect to the Korean Government's desire to obtain the benefits of Article 15(a) of the treaty, there would seem to be no necessity to oblige Japan to return the property of persons in Japan of Korean origin since such property was not sequestered or otherwise interfered with by the Japanese Government during the war. In view of the fact that such persons had the status of Japanese nationals it would not seem appropriate that they obtain compensation for damage to their property as a result of the war.

조약 15조 (a)항의 이익을 얻고 싶다는 한국 정부의 희망에 대해서는, 전시에 한국에 기원을 가지며 일본에 거주하던 사람들의 재산이 일본 정부에 의해 몰수되거나 또는 다른 형태로 방해되지 않았던 것으로부터 미루어보아, 일본이 해당 재산을 반환하도록 의무화 할 필요는 없다고 생각합니다. 해당인들이 일본 국민의 지위를 가지고 있던 사실로부터, 전쟁의 결과로서 그 사람들이 재산에 대한 손해 보상을 얻는 것은 타당하다고 생각하지 않습니다.
